Three arrested in aggravated robbery, threatened to "kill and rape" victim

AUSTIN, Texas - Three people have been arrested after they planned, robbed and threatened to "kill and rape" a victim, according to a police affidavit. 

On February 3, around 9:30 p.m. the Austin Police Department responded to a robbery service call at a gas station in North Austin. When police arrived on the scene they made contact with the male victim. The victim says he had been robbed after he had agreed to meet a friend that he attended high school with, according to the affidavit. 

The victim said he had agreed to meet up with 18-year-old Maricel Victoria Jimenez at a motel located at 11400 North Interstate Highway 35. The victim arrived at the motel around 7:06 p.m. and saw Jimenez near the pool area. The victim exited his vehicle and meet up with Jimenez and then the two walked to her motel room.

After spending a few minutes in the motel conversing, two males, later identified as 21-year-old Jacobo Ojeda-Cortez and 19-year-old Micheal Medina, exited the bathroom and began assaulting the victim. The two men shoved the victim to the floor and began going through his pockets taking his car keys, phone, and a $10 bill from his person.

After the assault, the suspects had the victim sit on the couch. While on the couch, Ojeda-Cortez pulled out a framing hammer and began waving it around telling the victim "don't do anything funny." According to the victim, he became fearful and believed he would be assaulted with the hammer if he did not comply with the Ojeda-Cortez's demands.

According to the affidavit, Medina then told the victim "You're lucky we didn't pull the gun out, we have it in a suitcase," before he went to the parking lot to retrieve the victim's vehicle. The victim was told to enter into his own vehicle. The suspects then loaded the vehicle with suitcases before driving the victim and his vehicle to Medina's aunt's house.

During the ride, Medina and Ojeda-Cortez told the victim that if he did "anything funny"  they would kill and rape him, says the affidavit.  

Upon arriving at the aunt's house, Jimenez and Medina unloaded the suitcases from the vehicle. At this time the victim asked Ojeda-Cortez why he was doing this to him and the suspect responded, "a (expletive)has got to do what he has to do." 

When the others arrived back at the vehicle they drove to a nearby restaurant before letting the victim out, parking, and fleeing on foot. 

On February 22, the victim was able to locate his phone at an ecoATM phone kiosk. Police were able to retrieve the victim's phone and obtained a photo of the suspects as well as a receipt for the transaction which identified Ojeda-Cortez as the seller. 

The three were arrested for aggravated robbery with a deadly weapon. 

Jimenez bond was set at $20,000 while Ojeda-Cortez and Medina's was set at $40,000.
